Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the website, online services, and products offered under the Freeland Passport initiative (the “Service”) operated by NPO Freeland (Freeland) (“Freeland”, “we”, “us”, “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Nature of Freeland Passport

1.1. The Freeland Passport is an alternative, non-state identification document issued by NPO Freeland (Freeland).

1.2. The Freeland Passport is not:

  • a territorial state-issued passport;
  • proof of citizenship of any territorial country;
  • a residence permit or visa;
  • a travel document guaranteed to be accepted by any government or authority.

1.3. Any acceptance or recognition of the Freeland Passport is solely at the discretion of third parties (such as companies, communities, institutions, or individual officials). We do not guarantee acceptance for any purpose.

2. Eligibility

2.1. You may use the Service only if you:

  • are at least 14 years old (or of legal age in your jurisdiction); and
  • have full legal capacity to enter into a binding agreement.

2.2. By using the Service, you represent and warrant that you meet these requirements.

3. Description of Services

3.1. Through the Service, we may offer:

  • registration and issuance of a digital Freeland Passport;
  • production and shipment of a physical Freeland Passport;
  • access to a personal account and verification tools;
  • related community and informational services.

3.2. We may modify, expand, or discontinue any part of the Service at any time, at our sole discretion.

4. Orders, Pricing and Payments

4.1. By placing an order, you submit a request for issuance of a Freeland Passport and agree to provide accurate and complete information.

4.2. Prices are displayed on the website and may be shown in fiat currencies, digital assets, or stablecoins (e.g., USDT). We may change prices at any time, but such changes will not affect already paid orders.

4.3. Payments may be processed via third-party payment providers and/or blockchain networks. You are responsible for any network fees, conversion costs, or bank charges.

4.4. Your order is considered accepted by us only after:

  • we receive full payment; and
  • we confirm acceptance by email or via your account.

We may refuse or cancel any order at our discretion (for example, in case of suspected fraud, sanctions issues, or incorrect data).

5. User Obligations

You agree to:

  • provide true, accurate, current, and complete information;
  • keep your account credentials secure;
  • not impersonate any other person;
  • not use the Freeland Passport for illegal or fraudulent purposes;
  • comply with all applicable laws in your jurisdiction.

6. Intellectual Property

6.1. All content on the Service (design, text, graphics, logos, images, etc.) is owned by or licensed to NPO Freeland (Freeland) and is protected by applicable intellectual property laws.

6.2. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes.

6.3. You may not copy, modify, distribute, sell, lease, or create derivative works from any part of the Service without our prior written consent.

7. Prohibited Uses

You must not use the Service:

  • for any unlawful purpose;
  • to infringe rights of others;
  • to attempt unauthorized access to our systems;
  • to interfere with the proper operation of the Service;
  • to circumvent security or technical measures;
  • to mislead authorities or commit fraud.

8. Third-Party Services

The Service may contain links or integrations to third-party websites, services, wallets, payment processors, or platforms. We do not control and are not responsible for such third-party services. Your use of them is at your own risk and subject to their terms and policies.

9. No Warranty

9.1. The Service and the Freeland Passport are provided on an “as is” and “as available” basis.

9.2. We make no representations or warranties of any kind, express or implied, including but not limited to:

  • suitability of the Freeland Passport for any particular purpose;
  • acceptance of the Freeland Passport by any authority or organization;
  • uninterrupted or error-free operation of the Service.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • NPO Freeland (Freeland) and its founders, officers, members, employees, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or opportunities, arising out of or in connection with the Service or the Freeland Passport.
  • Our total aggregate liability for any claim shall not exceed the amount you paid to us for the specific Freeland Passport related to that claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless NPO Freeland (Freeland) from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

  • your use of the Service or the Freeland Passport;
  • your breach of these Terms;
  • your violation of any law or rights of any third party.

12. Termination

We may suspend or terminate your access to the Service or cancel your order at any time if we reasonably believe that you have violated these Terms or applicable law. You may stop using the Service at any time.

13. Changes to the Terms

We may update these Terms from time to time. The updated version will be posted on the website with a new “Last updated” date. Your continued use of the Service after changes become effective constitutes your acceptance of the updated Terms.

14. Governing Rules and Dispute Resolution

14.1. These Terms are governed by the internal rules and principles of NPO Freeland (Freeland) as a non-territorial organization.

14.2. To the extent mandatory law of your country applies to consumer protection, such mandatory rights remain unaffected.

14.3. Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall first be attempted to be resolved amicably. If no resolution is reached within 30 days, the dispute shall be submitted to an internal dispute resolution panel appointed by NPO Freeland (Freeland) or, if agreed by both parties, to an independent mediator or arbitrator.
